Cape man charged with battery and aggravated assault

A man is accused of battering a woman and threatening her with a shotgun in the early hours of Saturday morning.

Andrew Neil Vichunas, 33, was arrested and charged Sunday with domestic battery and aggravated assault with a deadly weapon without intent to kill.

The woman reportedly told police Vichunas pushed her to the bathroom floor and dragged her by the hair into the master bedroom, kicking and spitting at her. He grabbed her by the hair and face then pointed a single-barrel shotgun at her face, saying, “I’m going to kill you.”

When Vichunas put away the shotgun, the woman waited in the bathroom for police to arrive, officers reported.

The incident began when Vichunas left the woman at a bowling alley where they had been drinking after he got into an argument with a friend, said police. The woman reportedly said Vichunas did not tell her he was leaving, and she remained at the bowling alley until getting a ride from a friend at about 2 a.m.

Police were dispatched to Vichunas’ address at about 3:41 a.m., but he had fled the residence, said police. A search of the area was “met with negative results.”

The woman was asked to contact police immediately if Vichunas returned to the residence. She contacted the police on Sunday stating that he had returned, and police arrived and arrested Vichunas, said officers.

Vichunas provided a written statement saying the woman was the primary aggressor and was intoxicated coming home from the bowling alley, said police. He said the woman hit him with her fists and shoes, and he only pushed her away then called a friend to pick him up.

Vichunas was placed under arrest and taken to the Lee County Jail in apparent good health, according to officials.
