Man wanted in Cape extradited to Lee County
A Cape Coral man accused of torturing and beating a man in June over an unpaid debt has been extradited to Lee County, according to authorities.
Oscar Perez, 28, of 1620 Palaco Grande Parkway, was booked into the Lee County Jail on May 20 on a warrant for two counts of kidnapping inflict bodily harm or terrorize victim or another and one count each of homicide willful kill murder not premeditated, robbery residence home invasion without firearm or weapon and grand vehicle theft, according to jail booking records.
Perez remained in the jail on $2,505,000 bond Thursday, the records state.
Capt. Lisa Barnes, spokeswoman for the Cape Coral Police Department, said Perez was arrested in Elizabeth, N.J., on Aug. 27. She explained that he likely had charges against him in New Jersey and that is why it took so long before he was returned to Lee County on the warrant.
“We did receive a warrant request from the Cape Coral Police Department. We received it June 20, 2009,” Samantha Syoen, spokeswoman for the State Attorney’s Office, said. “We signed it July 2, 2009.”
She explained that Perez could face the charges outlined in the warrant, but the SAO “has not received the full case for review yet” from the CCPD as of Thursday, so no charges have been officially filed by the state against Perez.
Perez’s attorney was unavailable for comment Thursday.
Perez and three others allegedly beat and tortured the man in the home of Perez’s mother on June 25 over an unpaid debt to her, according to police reports. Perez’s mother, Luz Huyo, was present during the attack. They also stole various items from the victim’s home, including a car, and threatened the man’s wife and children with violence.
Huyo was arrested and charged on June 26 with two counts of kidnapping inflict bodily harm or terrorize victim or another and one count each of aggravated battery cause bodily harm or disability, larceny theft $300 or more but less than $5,000, robbery residence home invasion without firearm or weapon and grand vehicle theft.
According to SAO records, one kidnapping count and the aggravated battery count had been filed by the state against Huyo as of Thursday. The home invasion robbery charge was not filed, and the larceny theft count had been amended to grand theft.
Neither Huyo nor her attorney were available for comment Thursday evening.
Also arrested and charged in connection to the June incident were Juan Antonio Rivera, 34, and Carmelo Jorge Lopez, 27, both of Fort Myers. The men each remained in the Lee County Jail on Thursday — Rivera on $90,000 bond and Lopez on no bond, according to jail booking records.
Barnes was unaware of a fourth man being identified as of Thursday.
Both Rivera and Lopez were booked into the county jail on Sept. 10 on a warrant for two counts of kidnapping inflict bodily harm or terrorize victim or another and one count each of aggravated battery cause bodily harm or disability, larceny theft $300 or more but less than $5,000 and robbery residence home invasion without firearm or weapon.
According to SAO records, both kidnapping counts and the aggravated battery count each had been filed by the state against Rivera and Lopez as of Thursday. The home invasion robbery charge had not been filed for either man, and the larceny theft had been amended to one count of grand theft.
Rivera’s attorney, Leonid Kremenchuker, had no comment Thursday.
Lopez’s attorney, Karen Elizabeth Miller of the Office of the Public Defender, echoed that.
“There’s no real comment at this time,” she said. “The case hadn’t progressed far enough.”
Perez has a court date set for June 21. Huyo, Rivera and Lopez each have a court date set for Tuesday.
