Man injuried in motorcycle accident released from hospital
A man has been released from the hospital after being ejected from a motorcycle last month.
As of Tuesday, Carlos Montalban, 32, of Delray Beach, had been discharged from Lee Memorial Hospital, where he was taken after the accident April 6 on U.S. 41 near Airport Road, officials stated.
At 3:21 a.m., Montalban was riding north on U.S. 41 on a 2003 Honda, which being driven by Michael Giovanni Agosto, 29, of Homestead, when they collided into the rear of a Honda Civic. The Civic was stopped for traffic and Agosto failed to slow down, the Florida Highway Patrol reported.
Due to the impact, Agosto and Montalban were ejected from the motorcycle.
Montalban, who reportedly was not wearing a helmet, sustained critical injuries and was taken to the hospital. Agosto was wearing a helmet and had minor injuries. He was also transported to the hospital.
The driver of the Civic, Policarpo Rangel, 55, of Cape Coral, was not injured in the crash, officials reported. Two passengers in Rangel’s vehicle, also Cape residents, were not injured either.
Upon being treated and released from the hospital, Agosto was taken into custody by the FHP.
He was arrested and charged with one count each of DUI unlawful blood alcohol, DUI unlawful blood alcohol serious bodily injury to another and knowingly drive while license suspended revoked, along with two counts of DUI unlawful blood alcohol damage property, and booked into the Lee County Jail.
Agosto was later released on $77,000 bond, according to jail booking records.
On Friday, the State Attorney’s Office decided not to officially file charges against Agosto.
Court records indicate that he does face a traffic infraction for careless driving.
