Driver charged with DUI manslaughter in crash with a fatality on Pine Island Road

A Colorado man is accused of DUI manslaughter following a fatal accident on Tuesday.

The Cape Coral police reported that David Patrick McDonough Jr., 54, of 420 County Road 339, Pagosa Springs, Colorado, has been arrested and charged with homicide negligence manslaughter vehicle DUI cause death to human or unborn child in the death of Charles Thomas Duffy, 52.

As of Thursday, McDonough remained at the Lee County Jail on $200,000 bond.

He has a court appearance scheduled for Aug. 21.

According to police, McDonough was driving a Ford F150 east on Southwest Pine Island Road in the 2100 block, approaching the German American Social Club of Cape Coral. At 4:42 p.m., he attempted to make a left turn into the club’s driveway, turning into the path of a westbound motorcycle.

The driver of the Triumph motorcycle, Duffy, of 1715 S.W. Fourth Place, skidded in an attempt to avoid a collision. The front of the motorcycle struck the passenger door of the truck, T-boning it.

Both vehicles came to rest in the driveway entrance of the club.

Duffy sustained life-threatening injuries and was trauma-alerted by ambulance to the Cape Coral Hospital, according to police. At 5:09 p.m., he died from the injuries that he had sustained.

McDonough sustained minor injuries in the crash, but refused medical attention.

Police reported that a DUI investigation was conducted on scene. McDonough was found to be under the influence of alcohol, drugs or both. He was taken into custody and eventually booked at the jail.

It was determined that Duffy was not wearing a helmet at the time of the accident.

Due to the investigation, the westbound lanes of Pine Island were shut down for several hours.
