Arrest made in January death of child

Earlier Tuesday, Cape Coral Police detectives, with the assistance of the U.S. Marshal’s Task Force, made an arrest in a homicide from January of this year.

On Jan. 29, 2017, Cape Police responded to 510 S.E. 9th Ave. to investigate the death of 13-month-old Mackenzie Fewox.

The months-long investigation culminated in a warrant request for the arrest Dustin G. Todd, 38, which was approved by the State Attorney’s Office for the following charges:

* 2nd Degree Murder

* 3rd Degree Child Abuse

Todd was taken into custody this afternoon at his place of employment in Fort Myers.

According to the CCPD,Todd and his wife were in the process of adopting the victim as she was a familial foster placement.

“The death of any child, under any circumstances, is heartbreaking,” Capt. Tony Sizemore, Cape Coral Police Department Investigative Services Bureau, said in the arrest announcement. “However, as our investigation began to uncover that this was a murder by someone who was supposed to protect her, it became especially gut-wrenching, even for the seasoned detectives of our Major Crimes Unit. This was a highly technical case that relied greatly upon forensic, medical, and good old-fashioned intuition and experience.”
